Kohima, April 01 (NEx): The 1st Quarterly Under Trial Review Committee (UTRC) meeting under the aegis of the District Legal Services Authority (DLSA) was conducted in 6 districts in the month of March during which a total of 08 Under Trail Prisoners (UTPs) or convicts were identified for consideration by UTRC, 04 UTPs were released on the recommendation of the committee and 1 (one) accused was identified for providing legal aid.
Under Trial Review Committee meeting was chaired by the District & Sessions Judge cum DLSA Chairperson consisting DLSA Secretary or district magistrate, Superintendent of Police, jail superintendent and officer from the Deputy Commissioner, and panel lawyer from DLSA reviewed the status and details of the list of UTPs/convicts lodged in respective jails under their DLSA and deliberated on those who were eligible for recommendation and release.
The report of the 1st quarterly UTRC meeting for the districts of Dimapur, Kohima, Mokokchung, Phek, Wokha, Zunheboto, said that as on the month of March, including jails in Dimapur (central & district jail), Kohima, Mokokchung & Longleng, Phek, Wokha and Zunheboto there are 224 UTPs and 81 convicts.
While Wokha and Zunheboto districts did not recommend any UTP/Convicts for consideration by UTRC for bail/ release, it observed that none of the accused or convicts were eligible for release on the ground that none of the jailers were in requirement of immediate medical attention or whose mandatory period has expired, the report read.
In Dimapur, 1 UTP sick or infirm and requiring specialized medical treatment was identified however, recommendation was not made for release.
Under Phek district jail, last meeting minutes were reviewed and 03 (three) UTPs were identified for release and bail was granted however no sureties were furnished.
The meeting further observed that there are no separate/cells for the convicts and UTPs. It also discussed for proper and effective investigation through crime conference and whenever possible.
In Mokokchung, the committee identified 2 (two) accused under section 436 CrPc and were recommended for release. Accordingly, they were released on bail bond. Also, 2 (two) accused who had been earlier released on bail but unable to furnish bail bond were also released on PR bond and 1(one) accused was identified for providing legal aid.
Under Kohima district jail, one UTP released on bail by the court but have not been able to furnish sureties and another UTP on compoundable offences were identified for consideration by UTRC and
further moved for recommendation.
The committee stated that UTPs recommended in the previous sittings were not present in the present sitting. It also discussed issues regarding UTP cell at Naga Hospital Authority Kohima.
The UTRC takes up cases of UTPs/ convicts under Section under 436A Cr.PC, UTPs released on bail but unable to furnish sureties, accused on compoundable offences, UTPs eligible under Section 436 A of CrPC, offences not more than 2 years imprisonment, or convicts who have undergone sentences or are entitled to release for remission granted or are eligible for bail, sick or infirm, women offenders, first time offenders between the ages 19-21, unsound mind among others.
